Terms of use - Exclusion of Liability

The visitor / user of our Website’s pages should read carefully the following terms and conditions of service provision before visiting or using our web pages and services and, in case of disagreement, should not make use thereof. Otherwise, it is presumed that he/she accepts such terms and conditions and grants his/her consent. The following terms of use apply to the entire content and anything included in our Website’s pages.
EVGA SA (hereinafter, for brevity’s sake, the Owner) may at any time modify the terms and conditions of use and the users / visitors are required each time to check for any changes and, if they continue the use, it is presumed that they accept the modified terms and conditions. Otherwise, they should refrain from using / visiting our Website.

Intellectual and industrial property rights

The entire contents of our Website, including but not limited to, texts, news, graphics, photographs, diagrams, illustrations, services provided and any kind of files in general is subject to copyright and governed by national and international provisions on Intellectual Property, without prejudice to explicitly recognized third-party rights. Consequently, any reproduction, republishing, copying, storage, sale, transmission, distribution, publication, performance, downloading, translation or modification in any way, is prohibited without the Owner’s express prior written consent.
Anything else that is contained in the pages of our Website and is a registered trademark or intellectual property of a third party belongs to their sphere of responsibility and has nothing to do with our own Website.

Obligations of visitor / user

The visitor / user of our Website must, on the one hand, comply with the rules and provisions of Greek, European and International Law and the relevant legislation governing telecommunications, and, on the other hand, refrain from any illegal or arbitrary use of our Website’s content and services. The visitor / user must also behave in a decent, polite and discreet manner during his/her visit and use of our Website, and the adoption of practices of unfair competition or other practices in conflict with NETIQUETTE (Code of Conduct of Internet Users) is expressly prohibited. The user / visitor shall be solely liable for any damage caused to our Website, or the Network in general, resulting from improper or illegal use of the relevant services by the user / visitor.

Limitation of Network’s liability

The Owner, without warranting, and, therefore, without being liable, shall use its best efforts to ensure that all information and content be characterized by the maximum accuracy, clarity, timeliness, completeness, correctness and availability possible. In no case, negligence included, shall the Owner be held liable for any damage caused to the visitor / user as a result of the use of our Website. 
The information and services are provided “as is” without any warranty, express or implied, which the Owner explicitly denies, including those of merchantability or fitness. 
The Owner does not guarantee the uninterrupted or error-free provision of the services and content, or even the lack of "viruses", whether as regards its Website, or another site server, through which you receive the content. 
Therefore, the Owner shall not be liable in any way for any consequential damages or loss of profits or direct or indirect damages resulting from the use of its Website.

Links to other sites

Our Website shall not be liable for the content and services of other websites to which it refers through “links”, hyperlinks or advertising banners, and does not guarantee their availability. Any problems that may arise during the visit / use of websites to which we refer shall be the exclusive responsibility of the respective sites, to which you should apply. Reference to other sites is for the convenience of our users and in no case does it create any form of commitment for any person.

Protection of personal information

The management and protection of the personal data of our Website’s visitor / user is governed by the terms of this Agreement and the relevant provisions of the Greek Law (Law 2472/1997, PD 207/1998, PD 79 / 2000 and article 8 of Law 2819/2000), as well as of European Law (Directive 95 / 46 / EC and 97 / 66 / EC).
Such data are not disclosed to third parties (except to the competent authorities, as provided by the law) and their personal character is preserved. Our Website keeps records of such data for purposes of communication, statistics and improvement of the services provided. 
Moreover, as regards “links” to other sites, our Website shall not be liable for the terms of management and protection of personal data that they apply. 
In any case, however, the visitor / user of our Website may, after contacting the competent department and ascertaining the existence of a personal record, request the deletion, correction or change thereof. 
Minors have access to our Website only with the consent of their parents / guardians and are not required to disclose their personal data.


It is hereby expressly agreed that, in the event that any action or claim, whether administrative or judicial, should be brought against the Owner as a result of your offense of any kind in the Owner’s Website, you assume the obligation to participate in the judicial proceedings, on the one hand, and to indemnify the Owner, if the latter is forced to pay damages or any other expense, on the other hand.

Applicable law and other terms

This Agreement is governed by the provisions of the Greek Law, the Directives and Regulations of European law and by the relevant international provisions, is construed in accordance with the principles of good faith, honest practices and the economic and social purpose of the right. 
If any provision is held to be contrary to the law and, therefore, void or voidable, it shall ipso jure cease to be in force, without affecting the validity of the remaining terms in any way. 
No modification of the terms of this agreement shall be taken into account and be a part hereof, unless expressed in writing and incorporated herein. 
The Courts of Athens shall be competent for any disputes in connection with these terms of use of this Website.
